TERMS:
The successful purchasers will be asked to sign the Seller's Real Estate Purchase Agreement on sale day and make an earnest money deposit equal to fifteen (15%) of the contract price. Sale will close within thirty (30) days after the date of the auction at which time the purchaser will pay the balance of the purchase price. A 10% buyer’s premium will be added to all purchases to arrive at a contract price. Purchaser to pay real estate transfer tax, purchaser will pay all other closing costs.

The information contained in this brochure and all related materials are subject to the terms and conditions of the purchase agreement. The property is being sold on an “AS-IS, WHERE-IS WITH ALL FAULTS” basis. The property will be sold for all cash. Each bidder must conduct and rely solely on their on investigation and inspection. Please review all information and seek appropriate assistance prior to attending and bidding at the auction. Announcements made from the auction podium take precedence over any prior oral statement or written material except for the fully executed purchase agreement and subsequent closing documents.
Conduct of the auction and increments of bidding are at the directions of the Auctioneer.
All properties will be sold subject to Seller’s confirmation within ninety-six (96) hours.
Under title X, the purchaser of a single family residence built before 1978 has a maximum of 10
days to inspect the property for the presence of lead based paint. The period of inspection begins
August 18-27, 2021. All bidders must sign a waiver of the 10 day inspection period.
SURVEY:
If the property sells divided, all property must be surveyed prior to closing by a licensed Georgia registered Surveyor. The Purchaser will pay the cost of the survey. The number of acres surveyed times the contract price per acre shall determine the final or actual purchase price to be paid at closing. Barfield Auctions, Inc. will have the final approval of the selected Surveyor.
AGENCY DISCLOSURE:
In this transaction Barfield Auctions, Inc. is acting as agent for the Seller not as Buyer’s agent, but does not have the authority to make representations on behalf of the Seller with respect to any matter.

EQUIPMENT TERMS AND CONDITIONS
- All prospective buyers must register and receive a bidder’s number. Acknowledgement of a purchase shall be made immediately by acceptance of the memorandum of sale indicating the purchase price and property identification number.
- Auctioneer reserves the right to reject any bid or disqualify any bidder due to financial or other reasons. The decision of the auctioneer as to any dispute between one or more bidders shall be final and binding.
- Bidder agrees to hold Auctioneer harmless for any injury to the person or property of any person whatsoever caused by bidder, or his agents, and further agrees to hold Auctioneer harmless for any personal injury or property damage incurred by bidder, or his agents, on the sale premises.
- Everything is sold “AS IS, WHERE IS.” Buyers are responsible for purchases when the auctioneer says “SOLD.” The last bid at an auction is an oral contract and is legally binding. All sales are final. All purchases must be paid for day of sale.
- Announcements by Auctioneer on Auction Day take precedence over printed matter
- Pickup and loading of purchased bid property is solely at the risk of the bidder/buyer. Auctioneer will not be responsible for any damage and is solely the responsibility of the bidder/buyer.
- No equipment shall be removed from the property until the sale is confirmed and the Purchaser’s check is cleared through auctioneers escrow account.
- Titles are not available on sale day and will be mailed to purchaser approximately 10 business days after satisfactory settlement. No titles will be available if vehicles are marked “No Title”.
- A 10% buyer’s premium will be added to all purchases to arrive at a contract price.
- All Sales will be subject to State and Local Sales Tax Laws.
