Terms

TERMS: The successful purchasers will be asked to sign the Seller's Real Estate Purchase Agreement on sale day and make an earnest money deposit equal to fifteen (15%) of the contract price. Sale will close within thirty (30) days after the date of the auction at which time the purchaser will pay the balance of the purchase price. A 10% buyer’s premium will be added to all purchases to arrive at a contract price. Purchaser to pay real estate transfer tax, purchaser will pay all other closing costs. DISCLAIMER: The information contained in this brochure and all related materials are subject to the terms and conditions of the purchase agreement. The property is being sold on an “AS-IS, WHERE-IS WITH ALL FAULTS” basis. The property will be sold for all cash. Each bidder must conduct and rely solely on their on investigation and inspection. The period of inspection begins March -15, 2023. All bidders must sign a waiver of the 10 day inspection period. SURVEY: If the property is to be surveyed, then the property must be surveyed prior to closing by a licensed Georgia registered Surveyor. The Purchaser will pay the cost of the survey. Barfield Auctions, Inc. will have the final approval of the selected Surveyor. AGENCY DISCLOSURE: In this transaction Barfield Auctions, Inc. is acting as agent for the Seller not as Buyer’s agent, but does not have the authority to make representations on behalf of the Seller with respect to any matter. BIDDING: In case of a tie bid, auctioneer reserves the right to reopen the bid between those two bidders. Auctioneer reserves the right to revoke any bid card at any time. Anyone bidding for an account other than their own must obtain a separate bid number for that account. BUYERS PREMIUM: A 10% buyer’s premium will be charged to all purchases made on auction day. NO WARRANTIES: All sales are AS-IS, WHERE-IS, and with all faults. Bidder has had the opportunity to inspect all sale items and bidder agrees to solely rely on his inspection. All sales are final. Bidder will not be entitled to any adjustment, allowance, or damages or any other remedy regarding the condition of any item purchased. AUCTION SITE: ALL BIDDERS AT THE AUCTION SITE ARE THERE AT THEIR OWN RISK. Bidder agrees the auction site is potentially dangerous because of heavy equipment operation. Regardless of cause, Auctioneer or its agents will not be responsible for any injury to anyone at the auction site. RISK OF LOSS: Once auctioneer accepts the highest bid, any item is then sold. Buyer then takes delivery and assumes all risk of loss for the item and buyer agrees to obtain full liability insurance coverage for the item as may be required by law. TITLES: Titles are not available on sale day and will be mailed to purchaser approximately 10 business days after satisfactory settlement. No titles will be available if vehicles are marked “No Title”. LOADING: All equipment must be removed two weeks after the sale.
